TERMS AND CONDITIONS - Unleash The Power Within

 

Engagement

1. Thank you for accepting our offer to present the Seminar Services to you. By placing an Order, you acknowledge that you have read these Terms and Conditions and agree that the placement of an Order, together with these Terms and Conditions, forms a contract between you and Success Resources Australia Pty Ltd.

Time and Place

2. Your payment of the Investment to us entitles you to:

(a) attend the Location during the Seminar Hours to receive the Seminar Services;

and

(b) to receive a copy of the Materials.

3. We may change the Speakers, the Hours, the Dates and/or the Location of the Seminar Services for any reason by notifying you in writing of the change and detailing substitute Speakers, Seminar Hours, Dates and/or Location and:

(a) we shall have no liability to you; and

(b) you shall make no claim against us (including for a refund), in respect of the same.

Investment and Payment

4. You must pay to us in consideration of the Seminar Services:

(a) the Investment Sum in one lump sum on the placing of the Order by you without set off, deduction or counterclaim; or

(b) if we have agreed that you may pay by Instalment, you must pay each Instalment to us in full and without set off or deduction the Instalment Sum on the Instalment Payment Date.

5. Payments made under this agreement must be made by the means specified in the Order.

6. If you should not pay to us an Instalment Sum by the Instalment Payment Date for that Sum then ALL monies owing by you to us shall become due and owing and must be immediately paid to us without set off or deduction or counterclaim and without need for further demand.

7. If Payments are not made by the due dates, the Seminar Services may be cancelled and no refund or credit will be given.

Cooling Off Period

8. If you advise us by notice in writing (including electronic mail to info.au@srglobal.com) within 3 working days of placing the Order that you do not wish to receive the Seminar Services this agreement shall be at an end and we shall refund you all monies you have paid to us under this agreement. If a refund is due from us to you, we will process it within 30 working days.

Transferring tickets

9. In the event that you are unable to attend the event you have booked and paid for, you can transfer your ticket the next edition of the event subject to notifying us at least 60 days before the event starts. If you need to transfer to another event inside 60 days prior to the start of the event, an administration fee of $495 will apply.

Complimentary tickets to any events, including those issued as bonuses when purchasing a main event, may not be transferred either to a new attendee or to an alternative event.

Refunds

10. We may cancel the Seminar Services for any reason by written notice to you. We will also refund you the Investment you have actually paid to us within 10 days of giving you notice of cancellation.

We shall have no further liability to you in respect of the cancellation.

11. You acknowledge that you shall not be entitled, and shall not claim a refund other than by strict compliance with clauses 8 to 10 and the Success Resources Australia Pty Ltd Refund Policy. You further acknowledge that this is an essential term of this agreement on which we rely.

Disclosures

12. You acknowledge:

(a) that neither Success Resources Australia Pty Ltd, any of our representatives or any person we engage to perform the Seminar Services (‘Relevant Persons’) is an investment advisor or licensed by ASIC or any other governmental authority to provide investment advice;

(b) that the Relevant Persons do not purport to provide investment advice or operate an investment advice business (as dfined in the Corporations Act 2001); and

(c) we may pay commissions to third parties arising from your entering into this agreement.

Ticket Sale and Resale

13. Event Tickets may not be transferred, be resold, or be offered for resale at a premium (including via on-line auction sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods and services, either by the original purchaser or any subsequent bearer without the prior written consent of Success Resources Australia Pty Ltd. If a ticket is sold or used in breach of this condition, the ticket may be cancelled without a refund and the bearer of the ticket may be refused admission.

Scalping warning: The resale of tickets in certain circumstances is governed by ticket sales legislation and may attract criminal penalties.

Force Majeure

14. If the Seminar Services as contemplated by this Agreement are prevented or cancelled because of an act of God, an inevitable accident, fire, blackout, flood or any other calamity, or if by reason of strikes, or lockouts, or any other events beyond the direct control of both parties, then the promoter may at its option either postpone the Seminar Services from the original Seminar Services date or cancel and refund as per clause 10.

General

15. All notices or other communications must be made to the addresses specified in the Order Form.

16. The non-exercise of or delay in exercising any power or right of a party does not operate as a waiver of that power or right, nor does any single exercise of any power or right preclude any other or further exercise of it; or the exercise of any other power or right. A power or right may only be waived in writing, signed by the party to be bound by the waiver.

17. Should any provision of this agreement be held by a Court of competent jurisdiction to be unlawful, invalid, and unenforceable or in conflict with any rule, statute, ordinance or regulation the validity and enforceability of the remaining provisions will not be affected.

18. This agreement constitutes the entire agreement between the parties. Any prior arrangements, agreement, representations or undertakings are superseded.

19. We reserve the right to alter speakers and course content at any time without notice.

Non-Disclosure Agreement

20. Client hereby acknowledges that they will be trained in material considered “trade secret” and con dential in nature. Client agrees to not disclose any techniques nor comments about the event of any kind to others, via forum, message boards, private emails, blogs or other venue. If Client does disclose any information about the event then they admit to damages and breach of contract and will be subject to civil litigation and damages. Client agrees to not create, nor partner nor associate with any person, any kind of product related to Success Resources Australia Pty Ltd, including but not limited to e-books, special reports, audio or video files, public postings of content, or any other derived materials. Client shall not record any portion of the event.

21. Client agrees to indemnify and hold harmless Success Resources Australia Pty Ltd against all loss or damage that client may suffer as a result by Success Resources Australia Pty Ltd and its speakers and associates and any of its a liates and representatives from any breach of these Terms and any other cause or alleged cause of any kind. Success Resources Australia Pty Ltd reserves the right to alter terms and conditions with prior notice.

Introduction

1. The following terms and conditions apply for Success Resources Australia Pty Ltd’s Unleash the Power Within 2016 competition (the “Competition”) and by submitting an entry into this Competition, entrants warrant that they have read, understand and agree to be bound by them.

Duration

2. Registration will be taken from 11:00am July 12 until 12 noon July 29, 2016 AEST.

3. Success Resources Australia Pty Ltd (the “Promoter”) reserves the right to extend the competition period at its own discretion.

Eligibility

4. Entry is available to permanent residents of Australia aged 18 years or over.

Method of Entry

5. To enter this Competition, entrants must enter either online by booking a ticket to Unleash the Power Within in Sydney 2016 at the official URL unleashthepowerwithin.com.au and must complete all mandatory fields. Or have made a phone booking to Unleash the Power Within in Sydney 2016 with the Promoter’s sales team. Or have made a booking to Unleash the Power Within in Sydney 2016 through one of the Promoter’s official affiliates. The entrant must be the purchaser of a ticket or tickets to Unleash the Power Within in Sydney 2016.

6. Inaudible, incomplete or incomprehensible entries (whichever is applicable) will not be eligible and will be disqualified. The Promoter reserves the right to disqualify any entry which, in the opinion of the Promoter, includes any content may be unlawful, profane, inflammatory, defamatory and/or damaging to the goodwill or reputation of the Promoter.

7. Any person who is discovered to have used or attempted to use more than one name in entering the Competition will be disqualified from participating in the Competition and/or redeeming a prize.

8. Unless otherwise stated in these terms and conditions, no person may enter this contest more than once and persons may not enter or participate in it on behalf of any third party.

9. All entrants acknowledge that the Promoter may rely on clauses 4.3 and 4.4 even after the Promoter has awarded or appeared to have awarded the prize to a person or after a person is announced as the prize winner. The Promoter reserves its rights to require return of the prize or payment of its value to the Promoter if this occurs.

10. Should an entrant's contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

11. Please refer to the general Terms and Conditions on www.empowernet.com.au regarding the purchase of Success Resources Australia Pty Ltd products and services. Judging

12. One contestant will be drawn at random will win the opportunity for a one-on-one photo with Tony Robbins at Unleash the Power Within in Sydney 2016 valued at $500. The promoter reserves the right to award additional prizes at their own discretion. The draw will take place on Monday August 1, 2016 at 11:00am (AEST).

Prize

13. The prize value is in Australian dollars and is correct at the time of printing.

14. There is one only prize to be won.

Prize Conditions

15. The Promoter does not warrant the merchantability, suitability and/or fitness for purpose of any goods and/or services awarded as a prize.

16. All prizes are subject to availability, non transferable and non exchangeable, must be used on any dates specified in these terms and conditions, by the Promoter and/or the prize provider and are not redeemable for cash unless cash is specified.

17. If a prize winner does not take any element of a prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that prize or any part of it.

Notification

18. The prize winner(s) will be notified by the email address they used to enter the competition.

Prize Availability

19. The Promoter will not be responsible or liable if, for any reason beyond their reasonable control, any element of any prize is not provided. The Promoter may, subject to State regulations, substitute a different prize of equivalent value in place of any prize referred to in these terms and conditions.

20. The Promoter will not be responsible for any changes in times or dates, or cancellations or rescheduling of events that may prevent the prize winner from redeeming the prize or any part of it.

Taxes

21. Any tax payable as a result of a prize being awarded or received will be the responsibility of the winner. Winner should seek independent financial advice prior to accepting a prize if this is a concern.

Unclaimed Prize

22. Prizes unclaimed after the event ends on September 11, 2016 will be forfeited subject to State regulations.

Publicity Materials

23. It is a condition of entry that the Promoter has the right to publicise the names, characters, likenesses of any entrants for any promotion or matter incidental to the Competition.

24. Entrants may be required by the Promoter to participate in photo, recording, video and/or film session(s) (the "publicity materials'') and acknowledge that the Promoter has the right to use such publicity materials in any medium (including, without limitation, the internet) and in any reasonable media it sees fit, unless that person advises the Promoter at the time of entering the Competition that he/she wishes to retain his/her anonymity.

25. Entrants also acknowledge that the publicity materials may be provided to the prize provider for the purposes of promotional display.

Copyright

26. By entering this Competition all entrants:

  • Assign to the Promoter all rights including present and future copyright in their entry and the publicity materials in all media (including, without limitation, the internet) and whether in existence now or created in the future;
  • Agree not to assert any moral rights in respect of their entry and the publicity materials (wherever and whenever such rights are recognised) against the Promoter, its assigns, licensees and successors in title;
  • Undertake to the Promoter that their entry is not in breach of any third party intellectual property rights.

Release and Indemnity

27. To the extent permitted by law, all entrants release from, and indemnify the Promoter against all liability, cost, loss or expense arising out of acceptance of any prize(s) or participation in the Competition including (but not limited to) loss of income, loss of opportunity, personal injury and damage to property, whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.

Tampering and Other Matters

28. If for any reason this Competition is not capable of running as planned as a result of any (including but not limited to) technical failures, unauthorised intervention, computer virus, mobile phone failure, tampering, fraud or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right (subject to State regulations) to disqualify any individual who (whether directly or indirectly) causes the same and/or to cancel, terminate, modify or suspend the Competition.

29. The Promoter accepts no responsibility for any late, lost or misdirected entries including but not limited to electronic messages not received by the Promoter due to technical disruptions, network congestion or any other reason.

30. The use of any automated entry software or any other mechanical or electronic means that permits any person to enter the Competition repeatedly is prohibited.

Leave for Participation

31. Obtaining time off work and/or study or related activities to participate in the Competition and/or a prize will be the sole and absolute responsibility of each contestant.

Exclusion of Participants

32. The Promoter reserves the right to exclude any person from participating in the Competition or a prize for any reason, including but not limited to, that person's medical condition or history, the preservation of the safety of the Promoter's staff members or any other person or because the Promoter deems that the behaviour of a person may bring the Promoter's brand into disrepute.

Termination of Competition

33. The Promoter may (subject to State Regulations), vary the terms of or terminate this Competition at any time at its absolute discretion without liability to any contestant or other person. The Promoter will not award the prize if the Competition is terminated.

Decision Final

34. All decisions and actions of the Promoter relating to the Competition and/or redemption of the prizes are exercised according its absolute discretion and are final. No discussions or correspondence with entrants or any other person will be entered into.

Failure to Enforce Terms and Conditions

35. A failure by the Promoter to enforce any one of these terms and conditions in any instance(s) will not give rise to any claim or right of action by any other person or contestant.

Personal Information and Privacy

36. The personal information supplied by entrants when entering this Competition will be used by the Promoter in accordance with its Privacy Policy. Please refer to the Privacy Policy for more information as entry in this Competition is an agreement to be bound by that policy. All entrants may have their details removed from the Promoter's database by simply contacting the Promoter or by sending an email to info.au@srglobal.com . If details are removed prior to the conclusion of the Competition and/or award of prize(s), entrants will forfeit their right to claim any prizes.
